The Community Referral Service Network,
(CRSN) maintains this site to inform you about its many offerings. In using this Site, you
agree to the Terms and Conditions (TAC) listed below. CRSN may Revise these Terms and
Conditions at any time by updating this posting. You should visit this page Periodically
to review these Terms and Conditions, because they are binding on you. CRSN wants you to
browse this Site freely. However, you do so at your own risk. By using this site, You
acknowledge and agree that CRSN is not responsible or liable for damages of any
kind(including but not limited to direct, indirect, incidental, consequential or punitive)
related to your use of the Site.
Disclaimer of Warranties
YOU EXPRESSLY UNDERSTAND AND AGREE THAT:
a).Your use of the network is at your sole risk. The network is provided on an
"as is" and "as available basis. The network expressly disclaims all
warranties of any kind, whether express or implied, including, but not limited to the
implied warranties of merchantability fitness for a particular purpose and non-fringement.
b). The network makes no warranty that: 1).The network will meet your requirements, 2).
The network will be uninterrupted, timely, secure, or error-free. 3). The results that may
be obtained from the use of the network will be accurate or reliable. The quality of any
product or services, information or other material purchased or obtained by you through
the network will meet your expectations and, 5). Any errors in the software will be
corrected. c). Any material downloaded or otherwise obtained through the network is done
at your own discretion and risk and that you will be responsible for any damage of any
such material. d). No advice or information, whether oral or written, obtained by you from
CRSN or through or from the network shall create any warranty not expressly stated in the
TAC.

The CRSN may provide, or third parties may
provide, links to other World Wide Web sites or resources. Because, CRSN has no control
over such sites and resources, you acknowledge and agree that CRSN is not responsible for
the availability of such external sites or resources. And does not endorse and is not
responsible or liable for any content, advertising, products, services, or other materials
on or available from such sites or resources. You further acknowledge and agree that CRSN
shall not be responsible or liable, directly or indirectly, for any damage or loss caused
or alleged to be caused by or in connection with use of or reliance on any such content,
goods or services available on or through any such site or resource. CRSN Assumes no
responsibility for the content of any sites it links to and has not reviewed the content
of such sites. Your access of those sites is at your own risk.
Feedback
CRSN welcomes your feedback however, any
communication or other material you send to the site by email or other means, including
your questions or comments, is considered non-confidential. By sending communications to
this site, you grant CRSN a royalty-free, perpetual non-exclusive license to use,
reproduce, modify, edit, distribute, perform and display any communication or other
materials you transmit to the site (and the ideas contained in such material) for any
purpose, including reproducing, posting or publicizing such material or using such
material for marketing purposes.
No Resale of Service
You agree not to reproduce, duplicate, copy,
sell, resell or exploit for any commercial purposes, any portion of the network, use of
the network or access to the network for your personal gain.
Marketing
Currently, no tax is levied on advertising.
However, in the event that a tax is imposed on advertising while this rate is in effect,
the advetiser agrees to pay the tax, which will be aded to the price of the advertisement.
Sponsorship Program (SP)
By entering the (SP), sponsor releases CRSN (1) and other promotional advertising
agencies, and each of their respective affiliated companies, directors, officers,
employees, representatives, partners and agents from any liability whatsoever for any and
all disputes, claims, costs, injuries, losses or damages of any kind arising in whole or
part, directly or indirectly, out of or in connection with the Sponsorship program
without resort to any form of class action; (2) any claims, judgments and awards shall be
limited to one dollar incurred, but in no event attorney’s fees; and (3) under no
circumstances will any sponsor be permitted to obtain any award for, and sponsor hereby
waives all rights to claim, punitive, incidental or consequential damages and any and all
rights to have damages multiplied or otherwise increased and any other damages, other than
the limited one dollar. CRSN reserves the right in its sole discretion, to cancel,
terminate, modify, or suspend part or all of this sponsosrship program should virus, bugs,
unauthorized human intervention or other cause beyond the control of CRSN.
Notice
The network may also provide notices of
changes to the TAC or other matters by displaying notices or links to you generally on the
network.
Indemnify
You agree to indemnify and hole CRSN,
and its subsidiaries, affiliates, officers, agents, co-branders or other partners,
employees, harmless from any claim or demand and all liabilities, cost and expense,
including reasonable attorney’s fees related to any violation of these terms and
conditions by you.
Limitation of Liability
You expressly understand and agree that
CRSN shall not be liable for any direct, indirect, incidental, special, consequential or
exemplary damages, including but not limited to, damages for loss of profits, Goodwill,
use data or other intangible losses (even if CRSN has been advised of the possibility of
such damages). Resulting from: (1) The use or the inability to use the network. (2) The
cost of procurement of substitute goods and services resulting from any goods, data,
information or services purchased or obtained or messages received or transactions entered
into through or from the network.(3) Unauthorized access to or alteration of your
transmissions or data.(4) Statements or conduct of any third party on the network.(5) Any
other matter relating to the network.
Termination
You agree that CRSN, in it’s sole
discretion may terminate your password, account (or any part thereof) or use of the
network, and remove and discard any content within the network, for any reason including,
without limitation, for lack of use or if CRSN believes that you have violated or acted
inconsistently with the letter or spirit of the TAC. CRSN may also in it’s sole
discretion and at any time discontinue providing the service or any part thereof, with or
without notice. You agree that any termination of your access to the network under any
provision of this TAC may be effected without prior notice, and acknowledge and agree that
CRSN may immediately deactivate or delete your account and all related information and
files in your account and/or bar any further access to such files or the network. Further,
you agree that CRSN shall not be liable to you or any third party for any termination of
you access to the network.
Modifications to Service
CRSN reserves the right at any time and from
time to time to modify or discontinue, temporarily or permanently, the network (or any
part thereof) with or without notice. You agree that CRSN shall not be liable to you or to
any third party for any modification, suspension or discontinuance of the network. The
network may also provide notices of changes to the TAC or other maters by displaying
notices or links to notices to you generally on the network.
General Information
The TAC constitutes the entire agreement
between you and The Community Referral Service Network (CRSN) and governs your use of the
network, superseding any prior agreements between you and CRSN. You also may be subject to
additional terms and conditions that may apply when you use affiliate services, third
party content or third party software. The TAC and the relationship between you and CRSN
shall governed by the laws of the State of North Carolina without regard to its conflict
of law provisions. You and CRSN agree to submit to the personal and exclusive jurisdiction
of the courts located within the county of Cumberland, North Carolina. The failure of CRSN
to exercise or enforce any right or provision of the TAC shall not constitute a waiver of
such right or provision. If any provision of the TAC is found by a court of competent
jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor
to give effect to the parties intentions as reflected in the provision, and the other
provisions of the TAC remain in full force and effect. You agree that regardless of any
statute or law to the contrary, any claim or cause of action arising out of or related to
use of the network or the TAC must be filed within 90 days after such claim or cause of
action arose or be forever barred. |
